Terms of Use

By using MicroX platform, you acknowledge your agreement to the terms and conditions outlined—whether you are a registered user or not—and understand that these terms and conditions are governed by the laws of Saudi Arabia. Your access to and use of the platform means acceptance of these terms and conditions, effective from your first use. The use of the platform may include terms and conditions that are subject to ongoing updates and changes as needed. Any modification or update to these terms and conditions will become effective immediately upon approval by NeLC. It is your responsibility to review the Terms of Use regularly. NeLC disclaims any responsibility if you do not continuously review these terms for updates. Your continued use of the platform signifies your full awareness and acceptance of any changes made to the terms and conditions.

Usage Restrictions

As a user of MicroX platform, you must use it only for legal purposes and acknowledge that you are responsible for any use that may violate the regulations in force in Saudi Arabia. By accessing the platform/website, you agree not to use it to commit a crime or encourage others to engage in any actions considered cybercrime or to upload or disseminate any content of a partisan-political or illegal nature that includes discrimination, defamation, or abuse. Additionally, you must not use the platform in a manner that conflicts with cybersecurity policies, such as uploading content or programs containing viruses or programs that may alter, damage, or delete any content on the platform, or impede its operation.

You must also refrain from publishing or broadcasting any advertisements, promotional materials, or any form of promotion, or sharing any content that you have not received permission to publish from its owner or that conflicts with others' intellectual property rights. Furthermore, you must not collect, store, or impersonate others' personal information or claim affiliation with any company or government or private institution without authorization.

Accessibility

MicroX is committed to facilitating access to MicroX platform in a manner that meets the needs of all user groups. Descriptive fields are provided for all media and files used to ensure they are readable and accessible. While NeLC makes every effort to ensure accessibility to the platform, some issues may still arise. If you encounter any problems, please report them to NeLC's support team via the call center or through the Contact Us Form (Contact Us).

Intellectual Property Rights

The National eLearning Center is the owner of the platform and owns the copyright and use of its content in accordance with the copyright protection system. This includes the software improved or modified therein or its content that is published on it such as text, images, audio and videos, databases, designs, and codes. Also, part of the content may be subject to the public domain and another part is subject to the rights of third parties such as intellectual property rights.

The Center also works to provide links for the purpose of facilitation, simplification or for informational purposes, and these links do not have any promotional content for goods, services or information, and when links to an external site are used, the user is subject to the terms and conditions of the owner of that external site, which do not indicate acknowledgment, sponsorship or affiliation with the third party, or the linked site. Also, NeLC does not review or control the content of third-party websites and disclaims responsibility for the accuracy of their content or when they violate the law.

Retention of Rights and Notification of Changes

The National eLearning Center reserves the right to review, follow up and request the editing or deletion of any content or information submitted and added to the platform, at the discretion of the Center and in compliance with the statutory regulations or procedures, or to respond to complaints from third parties or enforce this policy.

Violations

If you wish to inform NeLC of a violation of intellectual property rights or the Press and Publication Law, you must fill out the report form available on the platform, taking into account the following:
  • Identification of the act that violates intellectual property rights or the Press and Publication Law, and if this includes several acts, an explanatory list must be provided
  • Providing the necessary amount of information to enable the Center to take the necessary actions.
  • Providing the claimant's contact information via the (Contact Us) form
  • Ensuring that the content in question is protected by the law.
  • Accuracy when submitting data under penalty of legal liability.

Limitation of Liability

The use of the MicroX platform is the responsibility of each user of the MicroX platform and NeLC is exempt from the liabilities arising from any damage when providing the content and metadata "as is" without any warranty or representation of any kind, whether express or implied, including, without limitation, the representations of accuracy, completeness, merchantability, fitness for specific use and warranties, whether direct or indirect.

Scope of availability

Unless otherwise stated, some of the services available on the MicroX platform are available within the Kingdom of Saudi Arabia only and some are available outside the Kingdom.

Scope of Use

NeLC allows users to view and save the content of the MicroX platform for personal and educational use, provided that it is not commercial use. Furthermore, it is not permissible to access the platform, networks connected to them or the computer system in illegal ways. The user may also be held legally accountable if the content is used for commercial purposes such as selling it, or selling materials, products, or services related to the content, and the content may not be used to promote or advertise products or services, except after obtaining written consent from the Center.

Payment & Refund Policies

The payment and refund policy on the platform that requires financial claims is subject to the policies of NeLC based on the instructions for implementing the state’s general budget and the financial and accounting instructions.

Judicial disputes and the applicable Law

These terms and conditions and any subsequent amendments thereto shall be subject to and construed in accordance with the laws of the Kingdom of Saudi Arabia. Any disputes between the National eLearning Center, and other entities and individuals regarding this policy shall be resolved amicably. If the parties do not reach a solution within 15 days from the date of notice of the dispute, conflict or claim in writing to one of the parties by the other party, either party may refer such dispute, conflict or claim to the competent judicial authority in the Kingdom of Saudi Arabia.

Termination of Use

NeLC has the right, as it deems appropriate, to terminate or suspend the access to and use of the MicroX platform without any notice and for any reason whatsoever. Including any violation of these terms and conditions or due to any action that the Center may deem to be in violation of its regulations and policies. In the event of termination, access to the platform shall be no longer available.

Service Level Agreement (SLA)

NeLC is committed to facilitating users’ access to the MicroX platform in line with the needs of all beneficiary categories. It also provides descriptive fields for all media and files used to ensure that they are readable and accessible. The Center also ensures that the platform is accessible, however, some issues may still arise. If you encounter a problem, please report it to the Center’s support team via the call center or via the (Contact Us) form.
